What the Law Says
Art. 15.1 of the Ley de Propiedad Horizontal (LPH) is brief and clear:
"Attendance at the owners' assembly shall be in person or by legal or voluntary representation, a written document signed by the owner being sufficient to prove this."
That means: you do not need a form. No notary. No lawyer. A simple written note with your signature is enough.
What the Proxy Must Contain
For it to be valid, it should include:
Who is giving the proxy? Your full name, DNI/NIE number, shop number and address in C.C. Cita.
To whom? Name and DNI/NIE of the person who will represent you.
For which assembly? Junta General Extraordinaria, 18 April 2026, Comunidad de Propietarios Centro Comercial Cita, Maspalomas.
Your signature. Handwritten. Without a signature, the proxy is invalid.
Date.
That is all. Everything else is optional — but recommended.
Voting Instructions: Tell Your Representative How to Vote
You can give your representative instructions for each agenda item. That is your right. For example:
- Item 3 (Election of administrator): Vote for a professional management company.
- Item 3 (Election of administrator): Vote against candidate X.
- Item 3 (Election of administrator): Abstain.
If you give no instructions, your representative decides at their own discretion. That is legal — but it means you trust them. Think about whether you do.
Who Should You Give It To?
The law says: anyone. They do not have to be an owner. They do not have to be a member of the Junta de Gobierno. It can be a family member, a neighbour, a friend, a lawyer.
But think about it:
Give it to someone you trust — not someone who asks you for it. There is a difference.
Talk to that person. Ask how they will vote on each agenda item. If the answers do not convince you, give it to someone else.
Watch out for collectors. On 7 March, one single person held 26 proxies — nearly half of all the voting weight in the room. That is legal. But it means: if you give your proxy to someone who already holds many others, your individual vote becomes part of a block.
What You Do NOT Have to Do
No mandatory form. The assembly or the president cannot impose a specific template. Any written document with the above details and your signature is valid.
No ID copy required. Attaching a copy of your DNI/NIE is recommended but not legally required. If the assembly demands it and you do not have it, the proxy still cannot be rejected.
No deadline. The proxy can be handed over on the day of the assembly itself. There is no legal advance notice requirement.
No notary. Notarial certification is not required.
Who May NOT Vote
Art. 15.2 LPH: Owners who are behind on their community payments (morosos) may attend the assembly and participate in discussions, but have no voting rights.
Important: a moroso may, however, act as representative for another owner who is not behind on payments. It sounds contradictory, but that is what the law says.
Does Email Count?
Yes. Case law accepts a proxy sent by email, provided the sender's identity can be demonstrated. In practice, a photo or scan of the signed document sent via WhatsApp or email to the president or administrator is sufficient.
What Happened on 7 March — and Why Proxies Matter So Much
On 7 March 2026, only 34 per cent of ownership shares were represented. Two thirds of the community was absent. A single person — presidential candidate William Enrique — controlled, through 26 proxies, 47.5 per cent of all shares present.
That is not fraud. That is mathematics. And it shows: proxies decide who controls C.C. Cita.
Anyone who gives their proxy consciously is participating. Anyone who gives it thoughtlessly is handing control to others. Anyone who neither gives a proxy nor shows up has taken themselves out of the game.
