On March 7, 2026, William Enrique Reyes was elected Presidente of the owners’ association of Centro Comercial Cita. A professional transition plan was in place. The locks were to be changed within 72 hours, bank access secured within 48 hours. Eugenia Talavera Plata, William’s personal lawyer, confirmed the plan with the words “Ok perfecto”.
That was 40 days ago. Since then — as far as is publicly known — none of these measures have been implemented.
According to available information, the community's bank accounts have not been secured. At least one computer previously located in the community office can no longer be found, according to several owners. No official criminal complaint has been filed by the community.
The documentation from the former administrator Adhover has not been handed over within the required timeframe. Under the Estatuto del Colegio de Administradores, the most important records — bank access, owner registers, current contracts, insurance policies — must be provided within ten days of the Cese; the complete documentation within 45 days. Neither has happened.
And the Secretario who had pushed for the plan to be followed resigned on April 6.
In this situation, a co-owner of Centro Comercial Cita decided to no longer leave the open questions unanswered.
On April 16, 2026, three Burofaxes con Acuse de Recibo y Certificación de Contenido were sent. On April 17, a Denuncia (criminal complaint) was filed at the competent Juzgado de Instrucción in San Bartolomé de Tirajana. CITA News has all documents on file.
What is a Burofax?
Burofax con Acuse de Recibo
A Burofax is the strongest extrajudicial delivery instrument in Spanish law. Correos — the Spanish postal service — certifies both the exact content of the letter and its receipt by the addressee. A Burofax has full evidentiary force in court. The recipient can neither deny having received the letter nor dispute its content.
Three Burofaxes, three addressees
The three letters are addressed to the three individuals whose actions — or inaction — have been documented in previous parts of this series.
| William Enrique Reyes | Presidente CC Cita; Administrador Único Michaday S.L. | Accountability for bank accounts, measures regarding the missing computers, status of document handover, legal basis for Eugenia's operational role | 10 business days |
| Eugenia Talavera Plata | Lawyer, ICALPA 5844; William's personal legal adviser | Presentation of the Junta resolution that legitimises her — or immediate cessation of all activities. Transparency on compensation arrangements. Statement on the conflict of interest | 10 business days |
| José Hernández Pérez / Adhover | Former Administrador, Administraciones Horizontal y Vertical S.L. | Complete handover of all documents, clarification on the whereabouts of the computers, justification of the double billing (10,200 + 11,466 euros) and representation costs (14,400 euros) | 10 business days |
All three letters make clear: the demands relate to the period from March 7 to April 16, 2026.
They are based on the sender's property rights under the Ley de Propiedad Horizontal and are independent of any resolutions of a future Junta.

Adhover / J. Hernández PérezThe criminal complaint
In parallel, a Denuncia (criminal complaint) was filed at the competent court. It is directed against the same three individuals.
The complaint comprises ten sections of facts and four criminal law qualifications. At its core, it addresses the causal chain from Part 4 of this series: a plan existed, was accepted, then went unimplemented — with concrete consequences for the community's assets.
The criminal allegations
- Art. 252 Código Penal — Administración desleal (unfaithful administration): As Presidente, William had the legal duty to protect the community's assets. His systematic omissions — locks, bank accounts, criminal complaint — caused or enabled damage to the community's property.
- Art. 253 CP — Apropiación indebida (misappropriation): The missing computers were community property. They disappeared during a period in which the Presidente had taken no security measures.
- Cooperación necesaria (Art. 28 CP): Eugenia Talavera Plata led the handover process de facto — without a Junta resolution and with a simultaneous personal interest in the outcome. Her active involvement contributed to the situation in which the damage could occur.
- Art. 252 and 253 CP — against Adhover: The former administrator and his staff retained physical access to the office. The documentation was not handed over. The 2025 annual accounts contain conspicuous items.
Important: The Denuncia consistently uses the wording „podrían ser constitutivos de" — the Hechos could constitute the listed offences. It is the court's task to examine this. The Denunciante presents facts and classifies them legally. He does not pass judgement.

| March 7, 2026 | William is elected Presidente. Transition plan in place: 72 hours for locks, 48 hours for bank access. | Art. 13.3 LPH |
| From March 7 | Eugenia confirms the plan with „Ok perfecto“. Not a single measure is implemented. | Art. 1.101 / 1.718 CC |
| March 2026 | Locks remain unchanged. Former staff retain access. Computers disappear from the office. | Art. 252 / 253 CP |
| March–April | William files no criminal complaint about the missing computers — despite his duty of care as legal representative. | Art. 259 / 262 LECrim |
| April 6 | The Secretario resigns. On the same day, a new Junta General Extraordinaria is called for April 18. | Art. 13.5 LPH |
| April 16 | Three Burofaxes dispatched. | Art. 24 CE, LPH |
| April 17 | Criminal complaint filed at the Juzgado. | Art. 259 LECrim |
| April 18 | Junta General Extraordinaria. On the agenda: election of Eugenia as Administradora. | Art. 19 LPH |
Why now — and not after the Junta?
The question is obvious: why before the Junta — and not afterwards?
The answer follows from the documents themselves. All the failures described occurred between March 7 and April 17 — regardless of what is decided on April 18.
The fact that access was not secured, equipment disappeared and documents were not handed over does not change through a vote.
At the same time, the filing creates clarity: every owner who votes on Friday does so knowing that the open questions are now also the subject of criminal proceedings. This is not leverage — it is information.
What does this mean for the Junta on April 18?
Formally, the criminal complaint does not affect the legitimacy of the Junta. The owners can vote as they see fit. However: any resolution passed with the involvement of a person who exercises operational functions without a Junta resolution is challengeable under Art. 18 LPH within three months.
The Burofaxes have set a deadline of ten business days. The responses — or their absence — will determine what happens next.
The legal framework
The Burofaxes and the criminal complaint are based on a dense web of legal provisions:
| Art. 13.3 LPH | The Presidente is the legal representative of the community — in and out of court | William |
| Art. 14 LPH | The Junta de Propietarios is the supreme decision-making body | William / Eugenia |
| Art. 19 LPH | The Administrador is appointed by the Junta — not by the Presidente unilaterally | Eugenia |
| Art. 20 LPH | Duty of the administrator to hand over documentation upon change of office | Adhover |
| Art. 252 CP | Unfaithful administration — breach of the duty to protect others' assets | William / Adhover |
| Art. 253 CP | Misappropriation of community property | All three |
| Art. 12.A.5 CDAE | Professional duty to abstain in case of conflict of interest | Eugenia |
| Art. 1.101 CC | Liability for wilful misconduct, negligence and delay | All three |
What comes next
The deadline set is ten business days in each case.
If the recipients fail to respond or respond inadequately, further avenues are open to the sender: a civil claim for damages, complaints to the Colegio de Abogados de Las Palmas and the Colegio de Administradores de Fincas, and the challenge of any resolutions under Art. 18 LPH.
The Denuncia follows its own course — independent of the Burofaxes and independent of the Junta.
For forty days, no one answered. Now the questions are on record — with those concerned, with the postal service and with the court.
