What was missing — and what the correction says

The notice of 28 September was complete except in the one thing that mattered: plan, resolution, file number, legal bases, website, even the floor where the file is kept. No deadline — and without one nobody knows when it is too late. The correction uses “DONDE DICE” and “DEBE DECIR” and slots the four missing words into the sentence.

What the plan actually proposes

According to Resolución 185/2026 the plan was brought forward at the request of Mogán town hall to drive “the renewal and modernisation of the tourist resort”, and it was drafted by Gesplán. Three urban-planning agreements go on display — with Ingestursa over plots 12 to 16-C of blocks 10, 11 and 12, with Mogán Negocios S.L. for the “actuación de dotación” “Muelle Viejo”, and an addendum over plot 39.

According to Canarias7, the source of the figures, Ingestursa — the parent company of the Cordial Hotels brand — would be able to recut 9,121 square metres between Calle La Cruz and Avenida de Los Marrero, including a southern plot of 6,118.20 square metres for a new accommodation complex. Mogán Negocios S.L. would convert a holiday-apartment building of 2,881 square metres with 22 units, on a plot of 4,065 square metres, into an urban hotel, and hands the municipality land that would otherwise have to be expropriated.

The public side is in the document too: an urban park on Avenida de las Artes, renaturalisation and partial covering of the Mogán ravine, pedestrian priority, a panoramic lift up to Los Riscos and cycle lanes. New since the second consultation, per the “Contenido documental”, are a provisional coastal boundary along roughly 772 metres, which declares some 3,998 square metres of port access road and parking unnecessary for coastal protection, and protection for three buildings in the municipal heritage catalogue, among them the Ermita de San Fernando.

The same error, for the second time

The file goes back to 2016 and the Canary Islands government agreed the initiative in April 2018. At the first consultation, exactly what has happened now happened then: the notice in the BOC no. 26 of 5 February 2024 omitted the deadline, and Resolución no. 32 of 4 March 2024 added it, published in the BOP no. 30 and the BOC no. 54. The same administration, the same plan, the same missing detail, two years later. The correction carries a slip of its own: “Corección”.

Who may object — and where

A Spanish “información pública” does not use the narrow category of an interested party. Article 83.2 of Ley 39/2015 requires the notice so that “cualquier persona física o jurídica” — any natural or legal person — can examine the file, with no residence requirement. Hotels, tour operators and repeat visitors from Germany may write in too; under article 83.3 anyone who objects is entitled to a reasoned reply.

Where to send an objection is stated in none of the three documents. Article 16.4 therefore applies: an electronic register, a Correos post office, or an “oficina de asistencia en materia de registros”. Mogán town hall does it differently: its parallel notice on the Plan General names the electronic procedure and even the subject line to use.

The obstacles: Tuesdays and Thursdays, 1.67 gigabytes

Both routes to the documents have a catch. The file is available at the Dirección General, Plaza de los Derechos Humanos 22 in Las Palmas de Gran Canaria — but only “de 09:00 a 14:00 horas, los martes y jueves”: two days out of seven, and anyone living in Playa de Mogán crosses the island for it. Online it sits on the Planificación Territorial portal — as a ZIP file of 1.67 gigabytes.

Two points are left open. First, article 8.3 of Ley 2/2013 provides for “45 working days, or two months where strategic environmental assessment is required”; and article 21.2 of Ley 21/2013 sets a floor of 45 working days for public consultation. Two calendar months here amount to 41 working days, 45 would reach into the second week of December; which figure prevails is a legal question we cannot settle. Second, article 8.3 requires the notice in the Boletín Oficial de Canarias as well; in BOC issues 188 to 198, from 18 September to 2 October, we found none — but we did find, in BOC no. 193 of 25 September, one from the town hall on the Plan General, with 45 working days.
