What was struck down — and why

It is not the whole decree that fell, but its core. Void in full are article 5 (landlords' duties), article 8 (the single rental registry), article 9 (inscription procedure and application for the number) and article 10 (verification of the number). Void in part, in so far as they concern the registry procedure, are articles 1, 2 f), i), j) and 6. The ground is competence: according to the judiciary council's statement, the State lacks the title for "una regulación exhaustiva de un registro nacional que se superpone a los registros autonómicos existentes".

What an owner in the Canaries must do today

The route runs through the island, not through Madrid. Under article 7.1 of Law 6/2025 a "declaración responsable" must be filed with the Cabildo insular before letting begins; the Cabildo enters the activity ex officio in the Registro General Turístico. It must be accompanied by an expert description of the activity, in the case of commonhold a certificate that the community does not rule out tourist use, and a town-planning certificate from the municipality.

Letting may begin on the day of filing, under article 8.1. For the listing what counts is article 8.6: the inscription "contendrá necesariamente un número de registro", to be given in every advertisement, digital platforms included — that is the number for Airbnb or Booking. Under article 10 it runs five years, and ten on El Hierro, La Gomera and La Palma and in municipalities facing demographic challenge.

Those already letting: five years, then it ends

Anyone duly registered as a "vivienda vacacional" under Decree 113/2015 on 13 December 2025 falls under the second transitional provision: five years of continued operation as before, after which the old notification lapses and the activity ends "automáticamente" unless the dwelling has been authorised under the new regime. A single extension, to at most ten years, must be applied for at the Cabildo no later than four years after entry into force. Paragraph 3 expressly calls this period compensation "por todos los conceptos".

What no longer has a legal basis

Article 5 obliged the landlord to obtain the number in advance from the land registry and to pass it to the platform. It is void in full. The annual declaration was not there but in article 10.4: "Cada doce meses deberá aportarse el modelo informativo de arrendamientos de corta duración" — and article 10 is void in full too. The form for it was approved by ministerial order VAU/1560/2025 expressly "de conformidad con el art. 10.4"; that order has not been repealed. An invoice for an "annual NRUA report" therefore concerns a duty that no longer exists. A "renewal" of the number the decree never provided for: article 10.5 knew only withdrawal.

Open: numbers, fees, and no replacement rule

What survived is the digital single window (article 7), official statistics (article 11) and article 6 without its references to the national procedure; the platforms' monthly transmission of data continues. That a number must appear in the listing follows, since 20 May 2026, from Regulation (EU) 2024/1028, which leaves open which body issues it.

On numbers already issued and fees already paid, none of the three judgments says anything. Under article 73 of the administrative courts act such judgments do not "por sí mismas" affect the validity of administrative acts that have become final; the association ASCAV applied for reimbursement in May 2026. There is no replacement rule: the gazette lists as later references only the three judgments and two ministerial orders, and on the ministry's page the number was still called "un requisito indispensable" on 14 September 2026.
